First, let me be clear that I cannot comment on the quality of this firm's work. Unfortunately, after learning of their fee arrangement, I would never agree to hire them. While they were clear that they do not require an upfront payment for probate services, they do use an unusual fee structure for Georgia. The fee that was quoted to me was the greater of (a) a flat, base fee, or (b) a percentage of the value of the estate. The base fee itself was almost double what I had been quoted by several other firms, but what really surprised me was the contingency fee. I fail to see how it is fair to use the value of the decedent's estate to calculate a fee. For instance, whether the decedent's estate is worth 100,000 or 1,000,000, the work required of the law firm to probate the estate is the same. Why should a law firm receive a higher fee for the same work based upon the value of the estate's assets? And unlike a personal injury case where success is uncertain and a law firm is outlaying funds for upfront costs, probate is a fairly routine practice with the guaranty of success given a standard fact pattern and the structure of the laws that govern it. Of course, there could be unique situations in the course of any representation that might justify an increase in fees, but those instances could easily be handled on a case by case basis. For those looking for help with probate, my advice is to find a law firm that charges a reasonable, flat fee, and never agree to pay any percentage of the value of the estate as a fee.
